    I too am on the fence with this,,,

    We just recently made the decision to sell our home of the past 18 yrs that ewe built, raised our kids in & thought we would be in forever (till retirement anyway) etc etc
    One of the big deciding factors was in fact unrego`d bikes on residential street & on the dirt rd behind our property that is access to Private Property.

    My missus could not even use our clothes line because of the constant dust from idiots tearing it up back & forth when there is 100 acres beyond the back fence :angry:

    I love bikes as much as the rest of you, but it really pisses ya off when it is on you boundary day after day after day !!!!!

    When I was a kid there used to be such a place out in the Castlereigh State Forest. It was managed by the Police and Citizens Youth Club and would have trail bike cops out there on weekends. They also used to run Gymkanas there. I can only imagine it would have been insurance issues or something of that mater that had it closed down.

    Ok a bit of background info.

    Longterm farming & bike riding family, third generation cattle, third generation motorcycle club members, have 40 yr old track with amenities (BBQ, shelter, etc) setup, very sweet.

    Next door neighbour subdivides his property into 5-10 acre lots and sells, Brisbane & surrounds professionals & retirees bought and built, TBAG goggled, letterbox dropped the surrounding area, media reports daily swirtching sides, council forced to enact state legislation or cop flogging, farming family retailiates both in kind to weekend worriers & eventually physical confrontations and scuffles, out of local government hands, TBAG squzrks with glee, local riders form action group of their own….

    That’s where it is now.

    Some retirees round here complain about the cows and tractors next door, FFS what did they think the country is about, and we have to investigate every complaint.
    No fence sitting on the ethics of this one for me, professionally of course, privately will be attending every pro-bike meeting.

    I agree that you have to consider your neighbours doesnt matter where you live. If I owned a property of 400 acres or more I would think that I could build a track somewhere on the land that the noise would be acceptable for the neighbours . We all have to live with neighbours even in the country but I would like to think that a chat over the fence or over a beer could sort most problems out!! The issues seem to come from city people that move to the country in my experience. :huh:

    People say they are riding illegaly on their own property. What is the story with this is it the noise that is illegal or what? What is the difference with a bike to a ride on mower?

    I don’t think State Forests will let it happen because ya havta be rego-ed to ride in there. Unless some legislation changes are made I can’t see it happening. It would be nice and I support anyone tryin to achieve it but I just think it won’t happen cause of the rego thing. That’s why all the rides in the forest, riders have to be rego’ed and licence.

    and what will happen?

    If no one hears you are you really there?

    I know everyone want’s to get the most from their bike and so usually put on a performance muffler. Unfortunately most performance mufflers are also loud. If you ride near suburban areas or have neighbours that complain get a quiet muffler and save the performance one for when your out in the boondocks.

    We live on 3 acres, all the neighbouring properties have no fences over the other side of our creek so we end up with about 7 acres to ride on. New neighbours moved in (fortunately with bikes) and I made removeable muffler tips for them so the noise is kept low. When they want to go bush they just remove the tip. Sam has two mufflers one for home and one for bush, however if we’re riding near suburbia then the quiet one stays on.

    It can be done. Its called comprimise. If you really need extra power and ride in noise sensitive areas get a bike with a bigger motor (read more power) and keep it quiet. ;)

    I agree Adam, brenton has a “stealth” system on his KX for just this reason.
    However SOME people I am sure are just on a battle of wills or a power trip and want to enforce their beliefs upon others.

    It’s a sad state of affairs when you cannot legitimately ride your bike on your own proerty for other than directly agricultural purposes, and yes this is the law in NSW, you cannot ride legally for recreational purposes on your own land.

    A letter from the affected landholders at Kyogle. Their story.

    Our story; On January 25, 2010 a rep from our local Council was escorted onto our property by a Police Officer to hand us a STOP ORDER. This document prohibits either of us, our children or any other person from riding on our farm for fun.
    We have 480 acres 27kms north of Kyogle. We are smack dab in the middle of farmland. Between us we have 6 teenage children, only 3 are still at home this year, when we used ride around on our farm the kids would invite a couple of friends out so there would have been about 6-10 riders about once a month if we were lucky as we all work, farm and have other commitments just like most families do. In 2009 our 2 neighbours who are retired on 5 acres parcels complained about the noise from our dirt bikes. One of them is addicted to his lawnmower and spends hours and hours mowing his acreage. The other neighbour used to be OK until the new one showed up, anwyays…we have gone to court twice to defend ourselves and to try to explain to the Court its just a family riding on our own farm and we aren’t riding that much anyway as we work full time and the kids are in school all week etc. Plus the farm work to do on the wkds! Nothing we said was good enough. We were found guilty of “emitting offensive noise” this offence is a criminal act under the Environmental Operations Act (Noise Control) 2008. This law enables anyone to complain about any noise and it doesn’t matter how long, how loud (no db reading required) it just needs to be considered offensive by the “victim”. Our STOP ORDER has no expiration date or any workable terms. Our neighbours refuse to mediate our Council refuses to mediate. Why should they? They have legislation to back them up. According to our Council our STOP ORDER is permanent and totally justified by the Environmental Operations Act (Noise Control) 2008. Another family in our area have been threatened with the STOP ORDER, they also own acreage and are about 20km out of town in farm land, they have 3 sons of which only one rides regularly about 2 hours over the wkd. His neighbour has complained about noise and actually written to our local MP quoting the legislation. Kyogle Dirt Bike club is currently fighting council and a “neighbour” to get their DA renewed, what should have been a 6 week process of renewal has now taken over 6 months. Council is forcing them to get a NOISE reading, but it will just be a waste of money because the neighbour 2kms away from the Poker Run parking lot is going to complain about offensive noise under the ACT. The Kyogle Dirt Bike club is a small club that runs only 4 poker runs a year on 2 of its members farms. Council is trying to make life very difficult for this family based club.
    We are fighting for the right to ride on our own farm.
    We are fighting for the rights of our kids to be able to ride and their kids and so on. Our Council is so uneducated when it comes to who dirt bike riders really are. ~Jack and Kylie

    Just been reading through this thread and it is sad these days that tree changer people have become that selfish.

    I notice this when I head up to my parents house (100 acres), same as most people’s experience, all the neighbors fire up the ride on mowers from 7am on Saturday till 8pm on Sunday. If I so much as roll the red rocket off the back of the ute, bang on the door step “do mind not riding that this weekend ….. we have company” …. drives me nuts.

    No easy answers :(

    Might be also worth going above the local council’s head, one thing I have found useful in my work industry (not sure how it would translate to this scenario) is the NSW Ombudsman, they do tend to fight for good and evil, and they are legislated to mediate in the first instance, might be worth a shot.

    On the matter of the council order, have they had any legal advice ? not everything council’s do are legal or true to the act (after all they are individual’s interpreting the law ;) ), sometimes best to use the law against them :).

    Good luck to them, no easy fight there !!!!

    It sounds as though you don’t need a basis for a complaint – put a complaint against them with their noisy mowers going all weekend, get that banned – then sit down and have a discussion about compromise and removing the banns

    I’m with hatto on this one ,quite possibly alot of the time it is the people who spend quite a bit of time on there lawn mowers that would complain about bike noise

    Fight fire with fire just be prepared to use accellerant to speed up the process and give them some of ther own back
